Federal Court

Client charged by Federal indictment with embezzlement from his employer. Maximum sentence possible 10 years in Federal prison and a $250,000.00 fine. Pre- and post- indictment negotiations with the prosecutor, as well as zealous advocacy at sentencing, resulted in a sentence of probation. Result – client has spent no time away from his family.


State/Federal Court

Bank officer initially charged in Oklahoma State Court with embezzling more than $100,000.00. Case originally negotiated to probation in State Court. The case was picked up by Federal authorities, and re-charged in Federal court. Maximum sentence could have been 10 years in Federal prison and a $250,000.00 fine. Result – client sentenced to one year imprisonment, and is home with her family.


State Court

Client in his early 20’s charged with 1st Degree Murder as the result of a drug purchase gone bad. Maximum sentence: Life in prison. Case presented mitigating circumstances. Consequently, tough and difficult negotiation with the District Attorney resulted in a plea to 1st Degree Manslaughter, and a sentence of 10 years in prison, with 5 years suspended. Client released early on good behavior, and is now back with his family.


Federal Court

Client charged with receiving a package containing drugs and other contraband. Maximum sentence 20 years in prison and $250,000.00 fine. As a result of Mr. Kirkpatrick’s astute assessment of the case and zealous post-indictment advocacy, Defendant sentenced to probation.


State Court

Client charged in Delaware County with Drug Possession after former conviction of a felony. Result: Probation.


Bureau of Alcohol, Tobacco, Firearms and Explosives

Client administratively charged with allowing a so-called “straw purchase” of a firearm in violation of Federal Firearm statutes. Penalty could have been indictment in Federal Court as well as revocation of Client’s Federal Firearms License. Extensive negotiations with BATF resulted in the matter being referred to an administrative hearing in Oklahoma City. Result: Proceedings dropped. Client is operating his gun business today.


State Court

Client charged in Rogers county with embezzlement of employer’s funds. Negotiations with prosecution lasted 3 1/2 years. Result: Client received a deferred sentence.


Oklahoma Department of Health

Young EMT with two children, faces accusation that she stole narcotics from her ambulance. FBI and FDA investigated; Client and Mr. Kirkpatrick met with Feds. Feds refused to indict Client; the other EMT involved was convicted and sentenced to Federal Prison. Oklahoma Department of Health attempted to revoke Client’s EMT license. Case was referred to an Administrative Law Judge for hearing. Result: Client found not guilty and all charges dismissed. Client remains an EMT.


Federal Court

Client charged for being a driver for a major drug conspiracy. Minimum sentence of 10 years imprisonment; maximum sentence life. Extensive pretrial negotiations and advocacy resulted in sentence of 33 months in Federal prison.


Client, a naturalized American citizen of Russian descent, with probable connection to Russian organized crime, charged with conspiracy to plunder bank accounts through theft of credit card numbers. Client sentenced to bottom of guideline range.
